Terms of use


These Terms of Use govern the relationship between SIA Birne (registration No. 40203362135, registered address: Brīvības gatve 197A, Riga, LV-1039, phone: +371 26 413 646, e-mail: info@birne.lv), hereinafter referred to as the Seller, and persons who use the website www.birne.lv and place orders, hereinafter referred to as the Buyer.

The store provides goods/services in accordance with these Terms of Use.

1. General Provisions

1.1. These Terms of Use define the procedure by which the Buyer may order goods, make payments, receive goods, return them, as well as other information related to shopping.
1.2. Placing an order on the website www.birne.lv is considered an agreement (a distance contract) between the Buyer and the Seller and is subject to the laws and regulations of the Republic of Latvia, including the Consumer Rights Protection Law and the regulations on distance contracts.

2. Ordering Process

2.1. Product prices and specifications are displayed on the website next to each product.
2.2. To place an order, the Buyer must select products, fill in the required information (contact details, delivery address, etc.), and choose a delivery method.
2.3. After the order is confirmed and the invoice is issued, the Seller prepares the order for fulfillment.

3. Payment

3.1. Payment currency: EUR.
3.2. The Seller accepts payment by bank transfer to the account specified on the issued invoice.
3.3. The order is considered paid when the Seller receives confirmation of payment. If payment is not received within the specified period, the Seller has the right to cancel the order.

4. Delivery Terms

4.1. Delivery can be provided in the following ways:

  • Collection in person (Brīvības gatve 197A, Riga)
  • Collection from the warehouse (Kleistu iela 18A-2, Kurzemes district, Riga, LV-1067)
  • Delivery to parcel lockers

4.2. Delivery costs and time are indicated on the website before order confirmation.

5. Right of Withdrawal and Product Returns

5.1. The Buyer has the right to withdraw from the contract and return the goods within 14 calendar days after receiving them, without providing a reason.
5.2. To exercise the right of withdrawal, the Buyer must notify the Seller in writing (for example, by e-mail) and send a withdrawal form or notice.
5.3. The goods must be returned in the same condition as received — unused and in their original packaging. If the goods are damaged or misused, the Seller has the right to reduce the refundable amount.

6. Product Compliance and Warranty

6.1. The Seller guarantees that the goods comply with the specifications and quality described on the website.
6.2. If the goods are defective or do not match the order, the Buyer must notify the Seller without undue delay, but no later than 2 months after discovering the defect.
6.3. The Seller is obliged to correct the defect or replace the goods, as well as refund the payment if replacement is not possible.

7. Personal Data Processing and Privacy

7.1. The Seller processes only the personal data provided by the Buyer during the order process (name, surname, e-mail, phone number, delivery address, etc.).
7.2. Personal data may be transferred to third parties if necessary for product delivery or payment processing.
7.3. If the Buyer agrees, the Seller may send marketing information and offers to the Buyer’s e-mail address. The Buyer may unsubscribe from such messages at any time by contacting info@birne.lv.

8. Liability and Conditions

8.1. The Seller is not responsible for delays or losses caused by circumstances beyond reasonable control.
8.2. The Seller reserves the right to refuse an order or request the return of goods if the order information is incomplete or the price is incorrect.

9. Dispute Resolution

9.1. Issues not covered in these Terms shall be resolved through mutual negotiations between the Seller and the Buyer.
9.2. If the dispute cannot be resolved through negotiation, it shall be settled in accordance with the laws and regulations of the Republic of Latvia and the rules of the Consumer Rights Protection Centre (Patērētāju tiesību aizsardzības centrs).
